These executive order (EO) summaries are based on a cursory review; our lawyers and policy professionals continue to analyze these documents, and the directives they contain. Among other things, some of the directed actions may present significant constitutional questions that could be litigated and subsequently overturned or blocked.

America First Investment Policy

A National Security Presidential Memorandum (NSPM) establishing the administration’s policy objective of restricting investments from foreign adversaries in strategic US sectors, including technology, critical infrastructure, healthcare, agriculture, energy and raw materials. The NSPM additionally establishes policies to facilitate increased foreign investment from allies and partners. A fact sheet on the memorandum can be found on the White House website.

President’s Council of Advisors on Science and Technology

An EO establishing the President’s Council of Advisors on Science and Technology (PCAST) to advise the President on matters involving science, technology, education and innovation policy. The council will be co-chaired by the Assistant to the President for Science and Technology (APST) and the Special Advisor for AI and Crypto. It will comprise up to 24 members, including federal officials, as well as individuals and representatives from sectors outside the federal government. Removing Barriers to American Leadership in Artificial Intelligence

An EO directing relevant Trump administration officials to develop and submit an action plan within 180 days to “sustain and enhance America’s global AI dominance.” The order also mandates an immediate review of agency actions implemented under EO 14110 (“Safe, Secure and Trustworthy Development and Use of AI”), requiring revisions, modifications or suspensions of any actions found to be inconsistent with the administration’s objectives for advancing AI capabilities. Application of Protecting Americans From Foreign Adversary Controlled Applications Act to TikTok

An EO directing the Department of Justice (DOJ) not to enforce the prohibition on TikTok for 75 days. The Attorney General is further directed to provide written assurance to providers that no violations have occurred between the ban’s implementation on January 19, 2025, and the signing of the EO.
