Among other things, some of the directed actions may present significant constitutional questions that could be litigated and subsequently overturned or blocked.

A Plan for Establishing a United States Sovereign Wealth Fund

An EO directing the Secretary of the Treasury and the Secretary of Commerce to develop a plan to establish a sovereign wealth fund, including recommendations for funding mechanisms, investment strategies, fund structure and a governance model. The plan is also required to include an evaluation of legal considerations for “establishing and managing such a fund, including any need for legislation.” A fact sheet on the EO can be found on the White House website.

Strengthening American Leadership in Digital Financial Technology

An EO providing that it is the policy of the Trump administration to support the responsible growth and use of digital assets, blockchain technology and related technologies across all sectors of the economy. However, the EO prohibits federal agencies from undertaking any action “to establish, issue or promote” central bank digital currencies (CBDCs) “within the jurisdiction of the US or abroad.” It also revokes the Biden administration’s EO on Ensuring Responsible Development of Digital Assets and the Department of the Treasury’s “Framework for International Engagement on Digital Assets.” The EO establishes “the President’s Working Group on Digital Assets Markets,” to identify existing regulations that affect the digital asset sector and make recommendations for whether each identified regulation should be rescinded or modified. Delivering Emergency Price Relief for American Families and Defeating the Cost-of-Living Crisis

A memorandum directing leaders of federal departments and agencies to pursue appropriate actions to deliver emergency price relief for Americans and mandating a report to the President every 30 days on the status of implementation. The Organization for Economic Cooperation and Development (OECD) Global Tax Deal (Global Tax Deal)

A memorandum directing the Secretary of the Treasury and the Permanent Representative of the US to the OECD to communicate to the OECD that the OECD Global Tax Deal has no force or effect in the US absent future congressional action. The memorandum also directs the Secretary of the Treasury and the US Trade Representative to report on certain foreign tax policies that negatively impact US companies, as well as foreign noncompliance with US tax treaties.
