Senior Associate
Tom Prior is a senior associate in the Litigation team, predominately advising on commercial and corporate litigation.
Tom has strong advocacy experience, having appeared for clients and instructed senior counsel on a diverse range of matters in multiple state courts and administrative tribunals.
- Experience in acting for clients in Corporations Act 2001 (Cth) applications and disputes.
- Acting for a shareholder in oppressive conduct proceedings against the shareholder company in the Federal Court of Australia.
- Advising a large privately owned resource development group on a dispute with its financial advisor regarding the payment of a success fee relating to the sale of mining tenements in Western Australia.
- Acting for an NYSE-listed entity in proceedings in the Supreme Court of New South Wales regarding a commercial contractual dispute.
- Acting for an ASX-listed company in tribunal proceedings regarding a contractual dispute concerning a multimillion-dollar property development.
- Acting for a large property consortium in proceedings in the Supreme Court of New South Wales against its insurer relating to the insurer’s refusal to offer the company cover under an insurance policy.
- Advising directors and companies in relation to insolvency and bankruptcy matters.
- Acting for the Australian subsidiary of a public natural gas company in administrative merits review proceedings in the Northern Territory, regarding the minister’s decision to approve their environmental management plan.
- Acting for a public company seeking to register a trademark in Australia and responding to an objection raised to the registration of their mark.
- Acting for a medical supplies company in the Supreme Court of Western Australia alleging contraventions of the Australian Consumer Law (ACL) and breach of contract arising from the supply of personal protective equipment (PPE) during the COVID-19 pandemic.
- Advising a public company on potential legal risks associated with shareholder and regulator actions in relation to allegations of “greenwashing” and other environmental credentials.
- Defending a public manufacturing company against charges laid under the Environmental Protection Act 1986 (WA).
- Assisting in a pro bono capacity on a coronial inquest into the death in custody of a prisoner.
- Advising a global pharmaceutical company on the obligations and requirements regarding off-label prescribing in Australia.
- Advising a subsidiary of a large Japanese-corporation in proceedings it was joined to with its joint venture partners in the Supreme Court of Western Australia, regarding the boundary of mining tenements in the Pilbara, Western Australia.
- Advising a large Japanese-based company engaged in the manufacture and sale of beverages on Australian labelling requirements.
- Advising a Japanese pharmaceutical corporation on the requirements and obligations businesses must comply with when making environmental and sustainability claims on products sold in Australia.
