Jens Petry is a partner in our International Dispute Resolution and Litigation practices based in our Frankfurt office. Jens’ practice focuses on national and international dispute resolution. He regularly represents clients before civil courts and international arbitral tribunals in complex cases with high values. His priorities are the areas of intellectual property (IP), commercial and corporate litigation and cartel damages litigation. In IP matters, Jens’ practice includes litigation in the fields of patent, trademark, design and copyright infringement and competition law. Furthermore, he advises clients on their global anti-counterfeiting programs and represents them as damaged parties in criminal and customs procedures.

In more than 500 disputes, Jens has enforced clients’ rights in various courts in Germany, including courts of appeal and the Federal Supreme Court, as well as in international arbitration. He has extensive experience in the fields of medical devices, luxury goods and domestic appliances. Jens is a member of the German Association for Industrial Property and Copyright Law (GRUR) and the International Trademark Association (INTA).

International Arbitration and Commercial Disputes

  • Successfully defending a global producer of medical devices in a LCIA arbitration involving a damage claim of more than €560 million.
  • Representing a Saudi Arabian food distributor in an ICC arbitration involving a damage claim of US$68 million.
  • Representing an international airline in a €2 billion cartel damages case.
  • Representing the claimant in several cartel damages cases concerning a farina cartel involving damage claims of up to €140 million.
  • Representing the claimant in cartel damages litigation concerning the sugar cartel involving a damage claim of more than €30 million.
  • Advising an international manufacturer in the wind energy industry on a product liability dispute involving a €100 million damage claim.
  • Representing an investor from the United Arabic Emirates in a complex shareholder dispute involving various proceedings, including urgency proceedings, before the Frankfurt District Court and the Frankfurt Court of Appeals and criminal investigations with a total damage claim exceeding €18 million.
  • Representing a Spanish supplier in the automotive industry in a contractual dispute with a damage claim exceeding €20 million.
  • Representing a major German scientific publishing house in a contractual dispute with a renowned publisher.

IP and Press Law Disputes

  • Successfully defending a German welding torch manufacturer in a cross-border patent infringement case before the Frankfurt Court of Appeals involving a damage claim exceeding €10 million.
  • Successfully representing a world-leading producer of equipment for processing reactive resin in complex litigation concerning an employee invention before the Frankfurt Court of Appeals involving 15 patents and more than 500 alleged infringements.
  • Successfully defending a global producer of safety technology for the automotive sector in a patent infringement case before the Düsseldorf District Court.
  • Representing a well-known German producer of cosmetic products in patent invalidity proceedings against a multinational company.
  • Representing a German producer of kitchen appliances in patent infringement cases against foreign competitors exhibiting infringing products at trade fairs, including seizures and destruction of the infringing products.
  • Successfully representing a leading European distributor of two-wheeled vehicles in a series of German and European trademark infringement and cancellation proceedings before the Munich Court of Appeals and the EUIPO board of appeals.
  • Representing a US biotech company in a dispute concerning the theft of trade secrets before the Cologne District Court.
  • Advising one of the fastest growing Chinese companies in the field of electronic mobility on its global brand protection strategy.
  • Representing an international publishing house in a complex global trademark dispute and related settlement negotiations with a damage claim of €1.3 million.
  • Representing a well-known brand for kitchen appliances in multinational criminal investigations against a professional network of organized crime and coordinating undercover investigations in cooperation with EUROPOL in several European countries and China.
  • Coordinating the global anti-counterfeiting program for a world-leading producer of color cosmetics.
  • Coordinating IP enforcement measures in Germany, including online and retail market monitoring, border seizures and civil and criminal actions, for Swiss-based multinational producers of luxury goods.
  • Representing a government official of an Asian state in a press law dispute against an online publication and its host provider.
  • Representing a government official of a European state in a press law dispute against various, partially renowned German and European magazines.
  • Representing a world-leading rating agency in a press law dispute against a renowned German news magazine.
