Monika Lorenzo-Perez is a partner in the Restructuring & Insolvency Practice Group. Monika’s practice includes cross-border situations across a variety of sectors, including project finance, hospitality and leisure, retail, infrastructure, energy and natural resources in both distressed and non-distressed scenarios.

She acts for turnaround directors and directors of distressed companies. She also acts for financial institutions, creditors and distressed companies in connection with the restructuring of defaulting facilities, administrations, liquidations and receiverships.

Monika also advises on the enforcement of security and regularly acts for administrators, liquidators and receivers in relation to their facilities appointment and ongoing advice during the course of the insolvency.

  • Advising administrators, liquidators and receivers on their appointment, the disposal of assets, and ongoing advice during the course of the insolvency.
  • Conducting security reviews for secured lenders, and providing advice on restructuring, exiting the current facility and potential enforcement.
  • Advising turnaround directors on issues of corporate governance and on the legal aspects of financial and operational restructurings.
  • Advising distressed companies and their directors.
  • Advising trustees, agents and security agents on financial restructurings, high yield restructurings, scheme of arrangement and defaults.

Administration

  • Advising the administrators of Bernard Matthews in relation to the prepack sale of the business and assets of Bernard Matthews, including the paragraph 71 application, and advice during the course of the administration.
  • Acting for the administrators of Worldspreads.

Advisory

  • Advising the sponsor in relation to the financial restructuring of a hotel group based in London.
  • Acting for the sponsor and lender in relation to the restructuring of several real estate investments across London.
  • Advising turnaround directors of subsidiaries in the Lehman Brothers group that did not enter an insolvency process, on various matters, including settlement of the Lehman Brothers pension scheme, the wind down of a personal loan company based in the UK, the sale of an asset management company, rationalisation of group structures, the sale of assets, and general corporate governance advice to the directors.
  • Advising turnaround directors of a regulated Irish subprime mortgage company.
  • Advising turnaround directors on the migration of COMI from the Cayman Islands to England.
  • Advising a UK clearing bank’s Hong Kong branch on the enforcement of security and the appointment of receivers in England.
  • Acting for a US-based fund on the restructuring of a defaulting facility and the purchase of an additional facility provided to the same borrower.
  • Acting for a US-based fund in connection with the appointment of a receiver and the subsequent purchase by the US-based fund of the secured assets.
  • Acting for the sibling company and its director in respect of the regulated apportionment arrangement (RAA) in relation to the British Steel pension scheme.
  • Advising a Europe-based client on the restructuring of a loan secured over assets, and subsequent enforcement and appointment of English law administrators to the English holding company.
  • Acting for the security agent in connection with the English law facility of the Seadrill Chapter 11 and subsequent restructuring.
