Paweł Bukiel is of counsel in the International Dispute Resolution Practice Group.

Paweł specialises in international and domestic disputes, including corporate, commercial and administrative disputes, with particular experience in investment arbitration. He has a proven history of successfully representing clients before Polish state courts, including the Supreme Court, as well as in domestic and international arbitration courts.

Paweł is a lecturer at the Lazarski University in Warsaw. He is also a member of the Arbitration Council at the Lewiatan Court of Arbitration.

Investment Arbitration

  • Representing the Republic of Ecuador in an UNCITRAL investment arbitration brought by a US entity, under the Ecuador-US bilateral investment treaty, in connection with allegations of corruption, arising from the indictment and conviction for corruption of several Petroecuador former employees and providers in Ecuador and the US.
  • Represented a major Dutch hedge fund in an investment dispute resulting from a fraudulent take-over of one of its companies.
  • Advised an advertising company in an investment dispute over the state’s preference towards national operators.
  • Advised an investor of a major telecom company in an investment dispute over the state’s obligations regarding telecom services.
  • Advised a group of international investors in renewable energy power plants in a pending ECT arbitration regarding changes in subsidies for generation of renewable energy.

Commercial Arbitration

  • Representing a company specializing in global procurement and trade of industrial raw materials in an LCIA arbitration dispute against an importer and distributor of coal.
  • Advised a construction company in a dispute before the ICC International Court of Arbitration in Paris concerning payment of liquidated damages for the alleged improper performance of the construction contract.
  • Advised a pharmaceutical company in a commercial dispute over a licence for one of its new medications before the ICC International Court of Arbitration in Paris.
  • Lead counsel to one of the largest European producers of renewable solutions in packaging in a dispute over improper performance of the contract for construction of one of its production halls in Warsaw.

Litigation

  • Representing a client from the renewable energy sector in a commercial and corporate dispute against an innovative energy sector startup.
  • Lead counsel for a major biofuel company in over 40 disputes concerning the validity of shareholders’ resolutions.
  • Lead counsel for one of the largest global professional services networks in a dispute over alleged malpractice in the evaluation of a company for the purpose of restructuring.
  • Lead counsel for a producer of driver and passenger seats for busses and trains in a dispute with its business partner, one of the largest producers of railway rolling stock in Europe, resulting from a contract for the supply of a large quantity of components.
  • Lead counsel for a major international investment fund in over 30 civil and administrative proceedings regarding legal title to real properties.

Regulatory Disputes

  • Represented multiple clients before the National Appeals Chamber (KIO), including a major US energy company in a dispute over the Smart City Wroclaw project.
  • Advised clients with respect to proceedings before the President of the Polish Energy Regulatory Office.
