Graeme Bradley co-leads our Construction practice and was previously a partner at a major international law firm for 15 years where he had been head of the engineering and construction practice since 2000. Specialising in both contentious and non-contentious work throughout his career, Graeme has advised on documentation for major construction projects ranging from private client developments to major process plants in various sectors with particular interest in energy oil and gas process engineering projects.

Graeme advises primarily owners, both corporate and government, major contractors and capital funds.

He is familiar with all major contract forms including the NEC/ECC, FIDIC, IChemE, Model Form MF/1 – 4, JCT and ICE forms, EPC contracts as well as tailored contracts in sectors including energy, mixed-use facilities, leisure, process plants, ports, materials handling equipment, oil and gas facilities and transport.

Throughout his career Graeme has practiced all aspects of heavyweight construction dispute resolution including UK and international arbitration, litigation and bespoke dispute methods including dispute review/adjudication boards and alternative dispute resolution on major projects.

Graeme is an accredited mediator, having conducted many successful mediations as mediator, and also has been appointed in many disputes as an adviser.

Energy

  • Acting in adjudication for a major contractor in relation to an IChemE reimbursable EPC contract regarding Aberthaw Power Station.  Final account dispute for failure to certify actual cost based around issues of contract interpretation regarding reimbursable costs and deductions, KPIs and deductions for delay and alleged failure to exercise reasonable skill and care.
  • Acting in a dispute regarding increased costs incurred regarding a gas storage facility IChemE contract.
  • Acting in mediation regarding design defects on US-constructed power generation project.  Claim in UK against negligent consultant was settled at mediation.
  • Counseling in adjudication regarding Shotton Power Station, a 210 MW CHP power station, and the supply and installation of air cooled condenser.  Issues over LAD scope and enforceability. 
  • Acting for major engineering contractor regarding substantial claims in arbitration concerning Connahs Quay Power station
  • Representing in ICC arbitration regarding building of transmission line more than 300 kilometres in length, in Papau New Guinea FIDIC.

Infrastructure and Development

  • Acting in relation to contracts for Arco Towers development in Sofia Bulgaria.
  • Advising British Land on the iconic NatWest Tower development in Birmingham city centre.
  • Representing in a major infrastructure/development project with Sheffield City Council in relation to the redevelopment of Castlegate Markets in Sheffield.
  • Acting in a €30 million logistic project development of Concord, a 50,000 square metre facility situated to the west of Budapest in an established logistics area. FIDIC Design and Build.

Marine

  • Acting in a LMAA arbitration between Asia- and Middle East-based ship owner and France-based supplier over supply of liquefaction plant on board three vessels. Dispute valued at more than US$20 million.
  • Counselling in a dispute between the contractor and buyer of two jack up drilling units, the largest and most advanced ever built, on contract disputed claims valued at more than US$500 million.
  • Advising Korean Contractor in relation to a multimillion pound arbitration in Singapore regarding off shore jack up rig platform.
  • Acting in a UNCITRAL arbitration for NZ contractor regarding seabed pipeline contract dispute with an Asia-based government and related tailored ADR minitrial procedure.

Oil and Gas

  • Advising EPC contractor in relation to EPC contract for the construction of a US$20 billion pearl gas to liquid plant in Ras Lafan, Qatar.
  • Advising EPC contractor in relation to EPC contract for the construction of a US$500 million power and process plant in India.
  • Acting in relation to a contract for the fabrication, installation and commissioning of major boiler plant for a power plant based on the MF1 conditions.

Pharmaceutical

  • Advising a major contractor regarding its contract under PPC2000 for the construction of a major drug manufacturing facility in the north of England for a Hospital Trust.
  • Advising major pharmaceutical company employer regarding a turnkey contract for the production of a pharmaceutical plant using an amended IChemE form of contract.
  • Advising Dechra Pharmaceuticals on its drug manufacturing Project facility in the north west of England.

Process Plant

  • Advising on of the largest food process plant owners in Europe  in relation to its NEC form of contract.
  • Advising Corporate regarding its contracts for steel supply and the fluctuations in pricing mechanisms and resulting dispute regarding the indexation of supply.
  • Advising in a major dispute over defects and delays in construction and extra costs allegedly incurred by contractor regarding construction of plant for photographic paper.
