Nicole Bothwell is an associate in the Environmental, Safety & Health Practice. Nicole’s practice focuses on environmental compliance matters and regulatory advocacy. She has experience with numerous federal environmental statutes, including the Clean Air Act, the Clean Water Act and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), as well as various other state and federal regulations.

Nicole has experience in various regulatory advocacy matters, including submitting comments on US EPA rulemaking to effect regulatory change to benefit clients. She has developed a comprehensive understanding of her clients’ business needs and how to effectively communicate with the relevant regulatory bodies.

Nicole also works with the Life Sciences Industry Group and advises clients on a variety of Food and Drug Administration (FDA) regulatory matters. These include food and dietary supplement labeling, issues relating to recalled food and medical device products, and issues relating to innovations in food and beverage under FDA law.

Environmental Compliance Counseling
  • Providing guidance to chemical manufacturers regarding compliance with US EPA environmental regulations.
  • Providing advice to clients on label and marketing claims under FIFRA.
  • Advising industry clients on compliance with HON and MON regulations under the CAA.
Advocacy
  • Assisting with preparation of comments on key EPA rulemakings under CAA and TSCA.
  • Assisting with judicial review and reconsideration of agency rulemakings.
  • Assisting with negotiation and resolution of federal enforcement allegations under the CAA, CWA and FIFRA.
  • Assisting with lawsuit involving chemical manufacturer culminating in favorable resolution for client at federal appellate level.
Due Diligence and Transactional Work
  • Engaging in due diligence of environmental compliance issues related to M&A transactions and advising on risk management.
  • Engaging in due diligence of environmental compliance issues related to the development of wind and solar projects.
Life Sciences
  • Advising on nutritional labeling requirements for food and dietary supplements regulated by the FDA.
  • Advising on regulatory matters for medical device manufactures and entities in the pharmaceutical supply chain.
