Tamara Benáková advises clients in international or domestic disputes concerning areas of private international law, public international law and the law of the EU.

Tamara has represented clients in both arbitration and court litigation. In investor-state arbitration and commercial arbitration, Tamara has represented sovereign states, state-owned enterprises and private enterprises in disputes related to various industry sectors, including energy, construction, telecommunications, mining and finance. She has particular experience with commercial and investment disputes connected to armed conflicts.

Her expertise in court litigation covers rights arising from breach of contractual obligations, directors’ duties towards companies or real estate disputes.

Apart from her legal expertise, Tamara has a master’s degree in finances. Her knowledge of asset valuation is valuable, specifically in damages quantification or in disputes concerning corporate financing.

Investment Arbitration

  • Advising the Republic of Kosovo in an ICSID arbitration initiated by a German entity in connection with an alleged investment in the telecommunications sector.
  • Advising the State of Libya in an ICC investment arbitration initiated by a Turkish investor. The value of the dispute was €183 million.
  • Advising the State of Libya in a pending ICC investment arbitration initiated by a Turkish investor over a construction project. The value of the dispute was higher than US$61 million.
  • Advising the Republic of Kosovo in a pending ICSID arbitration initiated by an Estonian entity in connection with an investment in the microfinancing sector.

Commercial Arbitration

  • Representing a Czech energy concern in an ICC arbitration against a supplier of natural gas involving claims of significant financial value.
  • Representing a Slovenian pipeline gas buyer in an ICC arbitration against a supplier of natural gas involving claims of significant financial value.
  • Advising a major Czech and CEE group involved in aluminium, metallurgical and machinery industries, in an ICC arbitration against a designer and producer of industrial machinery.
  • Advising a natural person in an ICC arbitration regarding a dispute arising out of a share purchase agreement.
  • Advising a state-owned mining concern in a SCC arbitration against a Belarussian enterprise regarding a breach of claims arising out of development and construction of an underground mine and mineral processing facility.
  • Advising a Czech real estate development company in an arbitration at the Arbitration Court attached to the Chamber of Commerce of the Czech Republic and Agricultural Chamber of the Czech Republic regarding a dispute arising from a breach of the management contract for asset management.

Litigation

  • Advising a Czech real estate development company in court proceedings concerning the validity of a contract relating to the construction of a retail shopping centre.
  • Advising a client in Czech court proceedings initiated by a major mining company alleging claims for damages against our client of a significant financial value.
  • Advising a commercial real estate developer in a court dispute regarding the validity of contracts for the development of a new shopping mall project of substantial value, including the extraordinary appellate proceedings before the Supreme Court of the Czech Republic.
  • Advising a Swiss company operating in a petrochemical industry in a dispute with a Czech forwarding company concerning a breach of a contract for carriage of goods.
  • Advising a US company based in Cyprus in a dispute before the Supreme Court of the Czech Republic regarding the validity of the transfer of shares in the Czech subsidiary.
